Property: Several closes of land adjoining the messuage orchard and garden of Thomas Watkins in the township of The Holme, Lyonshall. The land is described in a map drawn upon the indenture.
Recites a Mortgage of 6 Jan 1813 [CJ87/56] where the property was mortgaged by Thomas Watkins senior to (2) for the sum of £80.
Recites a further mortgage of 7 Nov 1814 when the whole mortgage with interest was due, (3) requested a further advance of £12 against the property from (2). This was agreed to.
Recites a mortgage agreement dated 9 Dec 1825 where (2) agreed to a lease of his property to (4) for a term of 900 years in consideration of the sum of £500 + interest.
Recites a Commission of Bankruptcy dated 4 Mar 1827 against (2).
Recites an Indenture of Bargain and Sale dated 18 Apr 1826 between the Commission of Bankruptcy and (1) of all the property held by (2) to be held in trust by (1) for themselves as principal creditors and for any other creditors of (2).
Recites that part of the property was put up for sale by auction and realized £345 which was paid to (4) as part of the principal money and interest due to him from the mortgage of 1825.
Recites that Thomas Watkins senior died many years ago intestate and that (3) is his son and heir, and there is now due and owing the mortgage repayment of the capital and interest in the sum of £160.
Now (4) has contracted with (3) for the purchase in fee simple of the property for £160. (1) has agreed to this as repayment of the sum owing them from (2). (5) to act as trustee to the sale.
